These terms and conditions of use are applicable to the website, www.vdproductions.co.in (“Website”). Through the Website, the Companies provide users with access to information on fashion participants, Pet & Pet owners, business developers, sponsors, stakeholders, talent holders, designers, programers, etc., by VD Productions Events and provides access to images and videos of the events (hereinafter, “Services”).

The terms ‘Companies’ or ‘us’ or ‘we’ refer to the owners(VD Productions) of the Website. The term ‘you’ refers to the user of the Services on the Website.

These terms and conditions of use (the “Terms”) constitute a legally binding agreement between you and the Companies along with each of its officers, directors, agents, employees, consultants, suppliers, vendors and affiliates and govern the Companies’s relationship with you in relation to the Website.

The Companies provides the Services subject to the notices, terms, and conditions set forth in these Terms. In addition, when you use the Website, you will be subject to the rules, guidelines, policies, terms, and conditions applicable to such Services, which will be deemed to be incorporated into these Terms by reference. The Companies reserves the right to change or modify the Website, the contents thereof and these Terms at any time without any prior intimation to you. All modifications will be posted on the Website and will become effective immediately upon such posting to the Website. Please review these Terms regularly to remain informed of any change.

This Participant Agreement (“Agreement”) governs the terms and conditions between Participant (“you”) and VD PRODUCTIONS, an initiative of Craftworld Events and Event Capital (“VD PRODUCTIONS”) regarding your participation as a Participant on VD PRODUCTIONS.

1.Eligibility

You will be eligible to subscribe to the Services on the Website only if you are competent to contract under the Indian Contract Act, 1872. A person is competent to contract under the Indian Contract Act, 1872, if he/she is above eighteen (18) years of age, is of a sound mind and is not disqualified from contracting by any law to which he/she is subject.

2.Registration

You may visit the Website without registration or subscription and access the Content. However, it is possible that in the future some portions of the Website may be accessible by subscription only. At such time, you may subscribe to the Services on the Website after registering with the Website.

The information sought at the time of registration may include your username, name, age, email address, andphonenumber.

The nature of content made available to you is subject to change, the final decision of which lies with the Companies. The Companies reserves the right to introduce new subscription/any other packages from time to time, both free as well as paid.

This Website is controlled and operated by the Companies. All materials, including but not limited to illustrations, statements, opinions, views, photographs, products, images, artwork, designs, text, graphics, logos, button icons, images, audio and video clips and software (collectively, “Content”) are protected by copyrights, trademarks and other intellectual property rights that are owned and controlled by us or by other parties that have licensed their material to us. The Companies is constantly endeavouring to improve the quality of Services provided to you. The Companies reserves the right, at its own expense, to assume the exclusive defence and control of any matter subject to indemnification by you.

11.TermandTermination

These Terms will remain in full force and effect while you continue the use of the Website and/or avail of the Services at any level. The Companies retains the right to deny access to the Website and/or the Services to anyone who it believes has violated any of these Terms or does not accept these Terms.

We may also suspend or terminate your access if we are prevented from providing Services to you by circumstances beyond our control. The Companies may, in exceptional circumstances, cease to publish the Website, the Website content or cease to provide Services.

This Website, including the Content and Contributed Content and information contained herein, and the provision of Services shall be governed by the laws of the Republic of India and the courts of Chennai, India shall retain exclusive jurisdiction to entertain any proceedings in relation to any disputes arising out of the same. As such, the laws of India shall govern any transaction completed using this Website.

Information submitted or collected on the Website or pursuant to the use of the Services is stored in a database. Specifically, we store the username, name, e-mail address, contact number, as submitted or collected on our Website or through the provision of the Services. We may use such information to send out occasional promotional materials, including alerts on new Services available, or other promotional and marketing material relating to our clients and customers. The Privacy Policy shall be deemed and construed to be a part of these Terms, and any violation thereof by you shall constitute a

breach of these Terms.

Acceptance

These Terms & Conditions refer to the VD Productions Participations/Contributers as any. Please read the following information carefully before signing the agreement.

Use of Participant Images/Video

The participants and their parents to be photographed at the audition and the show.

VD PRODUCTIONS and its associate partners will be permitted to use a client’s name, images provided for the purpose of promoting VD PRODUCTIONS and the runway show/others they will be featuring in without limitation for the purpose of reflecting the ongoing and previous participation in VD PRODUCTIONS, also to promotional videos, websites, blogs, brochures, emails and catalogues.

Payment Terms

The final registration is not complete until payment has been received. Upon receiving payment the client will be issued a receipt and registration will be completed. Clients are requested to carry the receipt during the runway show.

Outfits/ Hair/Makeup/Things/Others etc., of the Participants.

Outfits for the participants would be solely decided by the designers and their team. Parents are not allowed to interfere in the decision making process by the designer and team. Outfits of the participants will be disclosed to their parents only during the Ramp show and not before that.

All participant’s hair and makeup done will be decided by hair and styling team and parents are not allowed to question the team.

VD PRODUCTIONS team is not responsible for the outfit selection or the hair and makeup of the participants or for any decision in selection of things,etc.,.

Restricted Areas

Entry of Parents/Non Participants/audience/pass entries is restricted to backstage area, main area, team area, monitoring area, makeup room, trial room, rehearsal room, near console area, on the ramp, and other marked restricted areas.

Disqualification

VD PRODUCTIONS has the right to disqualify any candidate at any point of time, on the basis of violation of VD PRODUCTIONS rules or any kind of misbehaviour of the candidate or their parents towards VD PRODUCTIONS team or volunteers.

Cancellation & Refund Policies

The following cancellation terms apply: All registration and payment entries/any are NON-REFUNDABLE due to the nature of these seasonal events

Dates and Venue

The Dates and Venues are tentative and may change on the discretion on the organising committee of VD PRODUCTIONS.

Show Format

VD PRODUCTIONS is purely a Development / Encouraging / Confidence Building Platform and not a Competition.

Entire Agreement

This Agreement comprises the entire agreement between you and VD PRODUCTIONS and supersedes all prior or contemporaneous agreements, written or oral, between the parties regarding the subject matter contained herein

GRATIFICATION:

A) CONTEST TERMS
The terms and conditions contained herein (hereinafter referred to as “Terms”) apply to the VD Events (the “Contest”) conducted by VD Productions and Saidhana Charitable Trust, ( “Organizers”) for Events, in connection with the Lakmē Fashion week in partnership with FDCI March’25 Edition ( the “Event”)
By entering the Contest, the participant (“Participant(s)”) agrees to be bound by these Contest Terms and the Contest Rules set out below.
The Organizers reserve the right to amend or cancel the whole or part of the Contest Rules, Prize and/or the Terms without notice. Any changes to the Terms, or cancellation of the Contest, will be posted on the Event website (www.vdproductions.co.in). It is the responsibility of Participants to keep themselves informed as to any changes to these Terms.
In the event of any dispute regarding the Terms, the conduct or results of the Contest, selection of a Winner or any other matter relating to a Contest, the decision of the Organizers shall be final and not subject to challenge or appeal. No correspondence or discussion shall be entered into, comment issued, or reason given in respect of any decision made by the Organizers.
The organizers will have the right to change / tweak the final design or any change in entire planning and execution, if required
The Organisers shall bear the cost of the print on the Official Merchandise

ELIGIBILTY FOR CONTEST PARTICIPANTS:

By entering the Contest, the Participant hereby warrants that all information submitted by the Participant on the email ID given by the organisers and the artist work is original and does not infiltrate any copyright in every respect. The Organizers reserve the right to verify any information contained in the Entry and/or the Participant’s eligibility to enter the Contest.
The Contest is only open to Indian nationals residing within the territorial limits of India during the Contest Period. Proof of age and/or identity, if requested, of the Participant (s), Winner, in the Entry must be submitted to the Organizers to confirm the eligibility of the Participant(s).
The Organizers reserve the right in their absolute discretion to disqualify any Participant if they have reasonable grounds to believe that such Participant has breached any of the Terms, any applicable law (including copyright law) or has otherwise infringed the intellectual property of any other person.
Each Participant acknowledges and agrees that any failure to comply with the Contest Rules and Terms could lead to the Organizers disqualifying such person, without the Organizers giving any reason for such disqualification or granting any opportunity for challenge.
In the event that a Winner is disqualified from the Contest for any reason, the Organizers will, unless otherwise stated in the Contest Terms, select an alternative Winner in the same manner as the original Winner and such selection will be subject to the Terms.

CONTEST ENTRIES

Entries shall be submitted on the email id provided by the organisers. By entering the Contest, the Participant agrees to be bound by the Contest Rules and these Contest Terms.
All Entries must be received latest of Events. Entries received after this date will not be considered for the Contest and shall be deemed null and void without requirement of any further intimation by the Organizers.
Neither (i) the Organizers and/or its group companies nor (ii) VD PRODUCTIONS Entities shall be responsible in the event that any Entry is not received or the Participant is unable to submit the Participant’s entry in the Contest due to any network problem, breakdown in machinery or any other technical error of any nature whatsoever. Any automated receipt confirmation does not constitute proof of actual receipt. For the avoidance of doubt, by submitting the Entry the Participant(s) is representing that the Entry or contents thereof are not confidential or comprise any sensitive personal information.
The Participant represents and warrants that the Entry being submitted by them shall be original and shall not infringe upon and/or contain any material that will infringe upon any third party rights including rights in intellectual property, and agrees to indemnify the Organizers and VD PRODUCTIONS against any liability / claims whatsoever arising in respect thereof.
Participation in the Contest is purely voluntary. There is no requirement to make any purchase in order to enter the Contest or access the Event website/ Event handles for entering into the Contest.
Unless otherwise stated in the Contest Terms, only one Entry per person/terms of the event planned by VD Productions or Saidhana Charitable Trust solely decide is only permitted. In the event that the Organizers discover or has reasonable grounds to believe that the same person has made multiple Entries, such person and any Entries made by them shall be disqualified and, if such Participant has already been selected as a Winner, an alternative Winner will be selected by the Organizers.
The Organizers reserves the right to retain all Entries submitted to the Organizers whether or not selected as Winner(s) and accepts no responsibility for the return of any Entries.

GRATIFICATION /PRIZE

The Winner shall be awarded:
- An opportunity to create a print for the Official Merchandise in consultation with VD PRODUCTIONS and for VD Week.
- A cash prize is fixed or not fixed according to the Event Conducted by VD Productions (Together the “Prize”)

Notwithstanding other provisions of these Contest Terms, the cash Prize shall be awarded to the Winner only insofar as and as long as not in contradiction with any applicable law. Further, all taxes relating to the cash Prize shall be borne by the Winner without any liability to the Organizers

LIABILITY

The Organizers and VD PRODUCTIONS accept no responsibility for any damage, loss, injury (other than our liability for personal injury or death as a result of our negligence) or disappointment of any kind suffered by any Participant in entering the Contest, including as a result of any Participant winning or not winning the Prize.
The Participant(s) hereby agree that they shall hold the Organizers, VD PRODUCTIONS, their respective affiliates, group companies, employees, officers, directors or any other person harmless from and against any injury/damage/harm/loss etc. suffered by them, in any manner whatsoever in connection with (i) any breach of these Contest Terms (ii) any conduct of such Participant or such Participant’s relatives or any person associated with such Participant, which results in any loss, damage, injury, harm, cost or expense to the Organizers and / or VD PRODUCTIONS; (iii) participation in the Contest. The Participant waives all rights to file in person/ through any family member and/or other Participant any applications, criminal and/or civil proceedings in any courts or forum in India to claim any damages or relief.

INTELLECTUAL PROPERTY RIGHTS AND DATA PROTECTION

The Participant shall retain intellectual property rights over the Participant’s Entry, however, in consideration of the opportunity for participating in the Contest, the Participant if selected as a Winner, gives the Organisers (and any third party authorised by the Organizers) a royalty free, worldwide, perpetual license to use, reproduce, publish and display the Entry on the Official Merchandise for promotional purposes
The Participant confirms that such Entry is original and that the Participant owns and have the right to license to the Organizers and VD PRODUCTIONS the copyright and other intellectual property rights in the Entry for the purposes of the Contest.
The Participant agrees that the Organizers and/or VD PRODUCTIONS and their designees and assigns may use the Participant’s name, voice, city / state of residence, photos, video or film clips, and / or other visual likeness for advertising and / or trade purposes and / or for any other purpose in any media format now or hereafter known without further compensation (financial or otherwise), permission or notification.

GOVERNING LAW AND JURISDICTION

The Courts of Chennai shall have exclusive jurisdiction in relation to any dispute or claim arising out of or in connection with the Contest, or its subject matter, existence, negotiation, validity, termination or enforceability
B) CONTEST RULES

The rules of the Contest and the Prize for each Winner are as follows:

The Contest will be open in the period term period od Event planning started to Event Date. (“Contest Period”).
Any person who wishes to participate in the Contest (“Participant”) shall agree with all the points mentioned in the Standard Terms.
The dates for the elimination round and final jury round will be conveyed to the Participants well in advance.
Under no circumstances will a Participant be allowed to drop out from the Contest after reaching the final jury round.
The Organizers reserve the right to set and amend the criteria used to judge Entries.
The Organizers reserve the right to select and declare the Winner in accordance with its applicable criteria and parameters and such decision shall be final and binding on the Participants and the Winner.
The Organizers/Sponcers shall bare the cost of production of the Official Merchandise
